Drivers' License Suspensions

If you have been charged with DUI in Kansas, you have 10 days (Weekends and Legal Holidays are excluded) to request an administrative hearing or your license will be automatically suspended. Last summer, the laws changed significantly in Kansas regarding driver license suspensions due to drunk driving.

You should receive a suspension notice (pink form) from the arresting officer. You must request an administrative hearing to contest the suspension. If you fail to request a hearing, your license will be suspended. This suspension may be for 30 days, 1 year, 2 years, 3 years or longer. You may also be required to install an ignition interlock device on your vehicle.

Hearings are conducted before an administrative judge from the Department of Revenue. The police officer should be present and your lawyer will get an opportunity to cross-examine him. The administrative hearing is different from the criminal case in that it is YOUR burden in the administrative hearing to show that you were not intoxicated to a level that you could not drive safely. That's tough to do. That's a big difference between the criminal case where it is THEIR burden to prove the case beyond a reasonable doubt.
