    Traffic Offense Attorney

Speeding ticket? Let our firm help!

Even one ticket can affect your insurance rates, employment and your privilege to drive, not to mention cost you considerable money in the long run. A Kansas City lawyer can help make addressing your ticket easier.

    • Clean driving record
    • No office visit or court appearance by you for many traffic tickets
    • Reasonable flat attorney's fee
    • Can be taken care of over the phone with major credit card

If you have been issued a ticket, call Martin & Wallentine immediately to start the process of having your ticket amended. Remember, Kansas is a moving violation state. If you accumulate too many moving violations in a year, Kansas can suspend your license. It is important to handle tickets promptly and appropriately to avoid this.

Suspension from Excessive Points / Moving Violations & Driving While Suspended

Kansas will suspend your license if you are ticketed and convicted for driving without liability insurance, as well as for having too many moving violations or points on your record. There are several requirements you will have to comply with to maintain your driving privileges, including:

    • You will have to pay a $100 reinstatement fee and maintain an SR-22 filing with the Driver Control Bureau for 12 consecutive months. (KSA 40-3118)
    • You will be forced to pay a fine between $300 and $1000 for your first offense. For following offenses that occur within 3 years of the previous offense, you will pay not less than $800 but not more than $2500. (KSA-40-3104)
    • This conviction is one of the three necessary convictions used by the Driver Control Bureau to revoke your license under the Kansas "Habitual Driving Statute" for a 3 year period.

Kansas labels you a habitual violator is you are convicted of or plead guilty to 3 or more of the following within a 5 year period:

    • DUI/DWI (even diversions)
    • Driving while suspended
    • Reckless driving
    • Failing to stop at the scene of an accident
    • No proof of insurance
    • Vehicular homicide

If you are termed a "habitual violator" you will face a 3 year license revocation with no hardship license. If you are facing criminal charges for driving with a revoked or suspended license, or risk revocation, call us today to discuss your case in a FREE confidential consultation.

If you are charged with driving on a suspended or revoked license, or face suspension because of too many moving violations or points, we will help you deal with the potential consequences. In Kansas, the consequences can be swift and severe for driving while suspended (DWS) or revoked (DWR). They include a minimum jail time of 5 consecutive days, and your license can be suspended for an additional 90 days or more. Kansas does not have a hardship or limited driver's license available to Kansas drivers.

If you are facing a DUI, you likely failed or refused chemical testing. The three forms of chemical testing include the Breath Test, Blood Test, and UA.

Contact a traffic offense attorney for legal assistance if you are facing criminal charges or the suspension of your license. We practice extensively and have represented hundreds of clients throughout Johnson County and cities including Olathe, Gardner, Lenexa, Overland Park, Shawnee, Leawood, and Kansas City.
