New Kansas Abortion Law in Effect

On April 19, 2013, the Kansas Governor signed the new law regarding abortions. On July 1, 2013, HB 2253 goes into effect which prohibits a person from performing or inducing abortions or attempting to perform or induce abortions in instances where the person has knowledge the pregnant woman is seeking an abortion solely on account of the sex of the unborn child. A first conviction is a Class A person misdemeanor. A second or subsequent conviction is a person felony. As a criminal defense attorney, I wonder whether the prosecution will ever be able to show that was the only reason. As a lawyer, I see the intention behind the law, but it will be interesting to see how it is actually applied.
