Man Receives Light Sentence After Rape of Child

A Judge in Montana is drawing quite a lot of harsh criticism for his light sentence on a rapist. The defendant in this case was a high school teacher who raped, and admitted to what had happened. He raped a 14 year girl in one of his classes on at least 3 separate occasions. The girl later committed suicide. The defendant was sentenced to 31 days in jail and more than 14 years on probation. The judge states that he weighed all factors in this case.

Over the last 6 years the defendant has showed good behavior and was actively involved in sex offender treatment. Therefore, the judge felt that community placement and treatment was best. Clearly, the criminal defense lawyer was very persuasive. However, the defendant did his part as well over the past 6 years. The attorney general's office is appealing the sentence, stating that is does not meet the mandatory minimum sentence for the state.
