The following is the Kansas Statute for Sexual Battery.
K.S.A. 21-3517. Sexual battery (.a) Sexual battery is the intentional touching of the person of another who is 16 or more years of age, who is not the spouse of the offender and who does not consent thereto, with the intent to arouse or satisfy the sexual desires of the offender or another. (b) Sexual battery is a class A person misdemeanor. (c) This section shall be part of and supplemental to the Kansas criminal code.
MIsdemeanor Sexual battery carries a one year sentence and a requirement to register as a sexual offender for a lengthy period of your life.
Aggravated Sexual Battery (Felony)
Aggravated sexual battery is even more serious. It is defined in K.S.A. 21-3518 as "the unlawful, intentional application of force to the person of another who is not the spouse of the offender and who does not consent thereto, with the intent to arouse or satisfy the sexual desires of the offender or another and one of the following factors occur: (a) the victim is a person under 16 years of age (b) the crime is committed in another's dwelling by one who entered into or remained in the dwelling without authority (c) the victim is a person who is unconscious or physically powerless (d) the victim is a person who is incapable of giving consent because of mental deficiency or disease, which condition was known by, or was reasonably apparent to, the offender.
Aggravated sexual battery is a felony that has a lengthy prison sentence which depends on your criminal record. It also has a mandatory sex offender registration.
