In a recent case, the court of appeals reversed a trial court in a divorce proceedings because the trial judge awarded wife spousal maintenance prior to considering whether she could support herself from the assets set aside to her in those same divorce proceedings. In other words, the trial judge first awarded Wife spousal maintenance ("alimony"), BEFORE addressing the property issues. The court must consider the property issues first to see whether Wife even needs maintenance. Below is a link to the opinion.
