Kansas Statutes: Drug Cultivation Laws

According to K.S.A. Supp. 65-4101(aa), “cultivating” a drug means to plant or promote growth of five or more plants that could be used to produce controlled substances of any kind. Examples include opiates and narcotic drugs, depressants, stimulants, and hallucinogenic drugs defined in Article 41 of K.S.A. Chapter 65. Under K.S.A. Supp. 21-5405, such offenses range from a class A nonperson misdemeanor to a severity level 1 felony. The punishments for the latter include up to 170 months of imprisonment and up to a $300,000 fine.
