Defining Fraud Charges

Fraud is a form of deception and comes in many forms. Under Kansas state law, different forms of fraud include:

  • Check fraud (K.S.A. § 21-5821): Making, drawing, issuing or delivering a check that is meant to defraud is a class A nonperson misdemeanor for a check less than $1,000; a severity level 9, nonperson felony for a check more than $1,000 but less than $25,000; and a severity level 7, nonperson felony for a check more than $25,000
  • Making false information (K.S.A. § 21-5824): Making, generating, distributing or drawing any written instrument, electronic data or entry in a book that is deceitful, with intent to defraud, is a severity level 8, nonperson felony
  • Counterfeiting (K.S.A. § 21-5825): Manufacturing, using, displaying, advertising, distributing or possessing with intent to distribute any item or services that bear or are identified by a counterfeit mark is a class A misdemeanor if the retail value is less than $1,000; a severity level 9, nonperson felony if the value is at least $1,000 but less than $25,000; a severity level 7, nonperson felony if the value is $25,000 or more

Kansas' Penalties for Fraud Crimes
