What are the Penalties for Firearm Theft?

K.S.A. 21-5801(b)(7) is the statute which recently made stealing a gun a felony. Specifically, the Kansas statute reads stealing “property which is a firearm of the value of less than $25,000 is a severity level 9, nonperson felony.” Prior to this recent law change, theft under $1,000 was generally a misdemeanor.

I think I may be one of the first Kansas criminal defense attorney to represent someone who was charged under this new law. They were charged with stealing a gun in Johnson County, KS, Even though the gun’s value was well under $1,000, it was still charged as a felony instead of a misdemeanor. The recent law change is not a surprise considering all the political rumblings regarding firearms.
