In Florida, as of October 1st a law was passed that made it illegal to have someone's personal information without authorization, in any form, including digital form. A 17-year-old man from Tampa was arrested on burglary charges but has also been charged with possessing someone else personal identification information, he had a picture of multiple bank account and routing numbers.
He will be the first person to face this new charge in Florida. Perhaps his criminal defense lawyer can pave a path. Kansas already has similar laws. In fact, for years, Johnson County, KS prosecutors have regularly charged such cases with multiples felony crimes, including theft and identity theft. In fact, as a Kansas criminal defense attorney, I have on many occasions defended clients dealing with such charges.
